ESTA Occupiers and the Construction of Buildings and Homesteads on Farmland: Addressing Critical Issues in Light of Prinsloo NO v Ngcongwane [2023] ZALCC 22 and Basfour 3327 (Pty) Ltd v Thwala (Leave to Appeal) [2023] ZALCC 28
Résumé
The purpose of the Extension of Security of Tenure Act (62 of 1997) (ESTA) is to enhance and promote the ideal of long-term security of tenure for occupiers of land on an equitable basis, promote land-tenure reform as a means of redressing the results of past discrimination and facilitate land-tenure justice. The history of land dispossession and labour tenancy is important to this context and connects with the purpose of ESTA. To fulfil the purpose of ESTA as contemplated in the Preamble, the objects of ESTA are, among others, to afford certain rights and duties to persons who reside on land that they do not own.
