Promoting ethical accountability amidst institutional pressures: a qualitative inquiry into the internal challenges of the Polokwane Office of the Public Protector, South Africa

Introduction This study examined the internal challenges affecting the ability of the Public Protector (PP) to fulfil its mandate of ensuring ethical accountability in the Polokwane Office, South Africa. The PP plays an important role in protecting both the public and the state by investigating maladministration and addressing public grievances. Although similar institutions exist globally, their powers differ. In countries such as Sweden and Finland, the PP has broader authority, including jurisdiction over the judiciary and the ability to prosecute cabinet ministers for unethical conduct. In contrast, most African countries, including South Africa, limit the PP to making recommendations rather than enforcing prosecution, which may constrain its effectiveness. Methods The study employed a qualitative research methodology to explore the role of the PP, identify internal challenges, and propose strategies to address these issues. Data was collected through interviews with 13 employees at the Polokwane Office of the PP and analysed using thematic content analysis. Results and discussion The findings indicate that employees recognise the constitutional mandate of the PP to investigate maladministration and promote accountability. However, the institution faces significant internal challenges, including financial constraints, shortages of specialised investigative skills, heavy caseloads, technological delays, and perceptions of political interference. These challenges negatively affect operational efficiency and institutional independence. The study recommends increasing budget allocations, implementing an effective Case Management System, amending the Public Protector Act to strengthen independence, introducing transparent appointment processes to reduce political influence, and developing staff retention strategies to enhance investigative capacity.
